Terms & Conditions

These Terms and Conditions apply to all goods supplied by the Company (Elektra Heating Solutions / Pedarson Ltd) to Buyers whether purchased:

By placing an order or using the Services, you agree to these Terms.

  1. DEFINITIONS

Company means Elektra Heating Solutions operated by Pedarson Ltd.
Buyer means the person or business purchasing Goods.
Consumer means an individual purchasing outside their trade or profession.
Business Buyer means a purchaser acting in the course of business (e.g., installer).
Goods means the products supplied, including underfloor heating systems, frost protection cables, thermostats, controllers and accessories.

  1. BASIS OF CONTRACT

A contract is formed when the Company accepts your order by confirming it in writing (email or online). The Buyer must confirm whether they are purchasing as a Consumer or Business Buyer.

  1. PRODUCT INFORMATION

We strive to ensure product descriptions are accurate. However:

  • Images and colours may vary by device.
  • Specifications may change due to product development.
  • Availability of products may vary.

This does not affect your statutory rights.

  1. PRICES AND PAYMENT

Prices are shown in Pounds Sterling. VAT is included unless stated otherwise.

Delivery charges are displayed before payment. We may correct pricing errors before dispatch and refund affected orders.

Title remains with the Company until full payment is received.

  1. DELIVERY

Delivery is complete when the Goods reach the delivery address provided by the Buyer.

Estimated delivery times are not guaranteed. We are not liable for delays caused by carriers or events outside our control.

  1. CONSUMER CANCELLATION RIGHTS

This section applies only to Consumers purchasing at a distance (online, phone, email, WhatsApp).

Under UK law you have the right to cancel within 14 days from the day after receiving the Goods unless an exemption applies (see below). To exercise your right you must notify the Company in writing within the cancellation period.

Goods must be returned:

  • unused,
  • in original packaging,
  • with all manuals, accessories, and seals intact.

You are responsible for return costs unless the Goods are faulty or incorrectly supplied. Refunds will be issued within 14 days of receipt of the returned Goods or evidence of return.

  1. EXCLUSIONS TO CANCELLATION RIGHTS

Your statutory right to cancel does not apply to:

  • Goods made to your specifications or bespoke measurements.
  • Goods that have been cut, installed, used, or altered.
  • Sealed goods that are not suitable for return once unsealed.

This reflects the statutory exemptions under UK law, as also described in the Elektra returns policy.

  1. RETURNS & HANDLING CHARGES

In addition to your statutory rights, we offer a goodwill returns policy:

  • Notify us within 30 days of delivery to request a return.
  • Returned Goods must be unused and in resaleable condition.

Handling charges may apply:

  • 15% for returns after 15 days from delivery.
  • 25% for returns after 30 days from delivery.
  • No returns accepted after 180 days from delivery.

Return costs are the responsibility of the Buyer. Delivery charges are not refundable for goodwill returns.

  1. FAULTY, DAMAGED, OR INCORRECT GOODS

If Goods are:

  • faulty,
  • damaged,
  • not as described,
  • or unfit for purpose,

your rights are protected under the UK Consumer Rights Act 2015. Where a fault is confirmed, you may be entitled to repair, replacement or refund.

Goods damaged in transit should be reported as soon as reasonably possible after delivery; this helps us investigate with carriers.

  1. INSTALLATION AND LIABILITY

The Buyer is responsible for ensuring Goods are correctly installed and appropriate for the intended application.

We are not liable for:

  • damage to property, floors, walls, structures, or finishes arising from installation or removal,
  • defects caused by incorrect installation, misuse, or failure to follow instructions,
  • work carried out by third parties.

We are liable for damage only where it is directly caused by a defect in the Goods supplied.

  1. LIMITATION OF LIABILITY

Nothing in these Terms limits liability for:

  • death or personal injury caused by negligence,
  • fraud or fraudulent misrepresentation,
  • statutory rights that cannot be excluded under UK law.

Except as above:

  • We are not liable for indirect or consequential losses (e.g., loss of profit).
  • For Business Buyers, liability is in any event limited to the purchase price of the Goods supplied.
  1. INTELLECTUAL PROPERTY

All content on the site (text, images, logos) is owned by the Company or its licensors and protected by intellectual property laws. You may not reproduce or distribute this material without permission.

  1. PROHIBITED USES

You agree not to:

  • use the Services unlawfully,
  • transmit harmful material or malware,
  • infringe intellectual property rights,
  • disrupt site security or operations.

Access may be suspended if misuse is identified.

  1. DATA PROTECTION

Personal data is processed in accordance with UK data protection law and our Privacy Policy.

  1. SEVERABILITY

If any provision is unenforceable, the remaining provisions remain in force.

  1. GOVERNING LAW

These Terms are governed by the laws of England & Wales and disputes shall be subject to the courts of England & Wales.
